Infringement By Microsoft Word’s XML Editor Upheld By Federal Circuit

Microsoft Corp. had failed to properly challenge patent obviousness and damages decisions against it, and otherwise had failed to prove invalidity and noninfringement of a technology used by Microsoft Word, the U.S. Court of Appeals for the Federal Circuit ruled Dec. 22 (i4i L.P. v. Microsoft Corp., Fed. Cir., No. 2009-1504, 12/22/09).
The court upheld a jury award of $200 million in damages and the district court judge’s $40 million enhancement for willful infringement. A permanent injunction against the company was affirmed as well, but current owners of the word processing software are unaffected, as the Federal Circuit set the injunction effective date as Jan. 11, 2010…
