Antitrust Claims Challenging Internet Music Sales May Proceed to Trial, Second Circuit Rules

Allegations that four of the nation’s major music labels colluded to fix prices on internet music sales may proceed to the merits, the U.S. Court of Appeals for the Second Circuit ruled Jan. 13, overturning a district court’s holding that the allegations were too vague to set out an actionable antitrust claim (Starr v. Sony BMG Music Entertainment, 2d Cir., No. 08-5637, 1/13/10).
