2010 OUTLOOK — INTELLECTUAL PROPERTY: IP Law Evolves — Some Progress Made in 2009; Additional Strides, Challenges Expected in 2010

For the first part of 2009, patent law reform dominated the headlines in intellectual property lawmaking, but Congress put the legislation to the side in May as other issues took center stage. There is no evidence yet when or if consideration of the pending bills will be revived this year.
At the time discussion was postponed, the Senate Judiciary Committee had reached a “compromise” on the most debated issue—damages reform. But the House of Representatives’ only significant action on the bill in 2009 included a statement that it had no intention of being a “rubber stamp” on the Senate’s compromise.
Most other issues in patent legislation focused on the pharmaceutical and biotechnology industries, as the relationship between the patent system and the availability of drugs from generic manufacturers drove several bill introductions…
